Privately Made Firearms and Current FFL Requirements

An FFL that chooses to acquire a privately made firearm into inventory generally must identify, mark, and record it under the current federal PMF rules within the required timeframe or before disposition, whichever occurs first.
An FFL is not required to accept a PMF. EC Enterprises must review the firearm, markings, owner, requested service, timing, and current legal status before approving intake.
Marking and timing
ATF's current guidance says an FFL acquiring a PMF must place or arrange the required unique identification within seven days of acquisition or before disposition, whichever is sooner. Existing qualifying marks may sometimes be adopted under the rule's conditions.
Records and Form 4473
The licensee records PMF as the manufacturer when applicable and follows the acquisition, disposition, and Form 4473 requirements for the actual transaction. Same-day adjustment or repair returned to the same person can have a different record path under current guidance.
Why EC must review before intake
An unexpected PMF can create immediate marking, timing, and record obligations. EC therefore needs photographs and a description before the firearm arrives and may decline it or require a different service route.
- Do not ship or drop off a PMF without approval.
- Provide clear photographs of all existing markings.
- Describe who made or assembled it and the requested work.
- Disclose any regulated configuration or uncertain component.

Must an FFL accept a PMF?
No. ATF expressly states that an FFL is not required to accept one into inventory.
Can another engraver mark it for the FFL?
ATF guidance provides limited paths involving another licensee or an engraver under the acquiring FFL's direct supervision. The acquiring FFL must control the process.
Does same-day gunsmithing always require PMF acquisition and marking?
Current ATF guidance describes a same-day adjustment-or-repair exception when the firearm is returned to the person from whom it was received, but the exact facts must be reviewed.
